The balance of interests in international investment law: a general legal principle applicable to the relationship between investment and the environment.
Author: Cosme G. Mekpo,
With the resurgence of environmental problems, international investment law is now facing the urgent need for its own adaptation. As the unique response to this categorical imperative, the balance of interests is emerging as a general principle of law (GPL), flexible and autonomous in nature. Its various functions (logical, axiological, unifying, and corrective) give it operational utility within the international legal order, and its implementation in international investment law reflects its evolving dimension. As a reference principle, it is consubstantial with international investment law and aims to prioritize one normative ideal (the law of balance) over another (the law of protection). However, the paradox of the balance of interests lies in its being both an affirmation of the principle of regulatory sovereignty and a limitation thereof. Initially, its implementation involves taking the public interest into account in the balance between the state and investors, and subsequently, this requirement only materializes after a dual test of proportionality and reasonableness.
"The Most Favoured Nation (MFN) clause and its impact on investment arbitration: a look at recent awards"
Does the Most Favoured Nation (MFN) clause automatically grant parties access to dispute resolution mechanisms? This question remains a recurring one and is currently generating considerable interest among arbitral tribunals. After an analysis of the issue, this article offers a comparative reading of the various positions—both doctrinal and jurisprudential—that continue to fuel the controversy. It first explores the potential for extending the MFN clause to investment arbitration proceedings. It then attempts to define the connection between this extension and the issue of broadening the jurisdiction of arbitral tribunals.
